  • Signing a sworn statement: Both parents can sign an Acknowledgment of Paternity Affidavit at the hospital or the local health department.
  • Using the child support office: A Child Support Enforcement Agency can conduct genetic testing and issue an administrative order.
  • Obtaining a court order: Either parent can file a complaint in juvenile court to request a paternity order and DNA testing.

Establishing paternity creates a legal relationship but does not automatically grant the father custody or parenting time. The mother maintains sole custody until a court intervenes.

Gaining Parenting Time and Custody

After establishing paternity, a father can petition the court for parenting time or shared custody. The court will always focus on what is in the child’s best interest when making a decision.

Judges weigh several factors to determine the best arrangement. They look at the mental and physical health of the parents, the child’s relationship with family members and any history of domestic violence. The court also evaluates which parent is more likely to honor and facilitate future parenting time.

Paying child support does not automatically grant a father the right to see his child.
