How Does the Ohio Juvenile Court System Work?

The juvenile delinquency process typically starts when any person files a complaint against a juvenile offender who knows the child may be a delinquent child, per Ohio Rev. Code § 2152.021. Furthermore, a law enforcement officer may take a child into custody if they find a child has perpetrated a delinquency.

After the juvenile or child has been taken into custody, they will either be taken to the detention center or released to their guardian or parent. The minor may not be held in custody for more than three hours before being released or sent to a detention center; nevertheless, they may be held for up to six hours for certain offenses before being released or sent to a detention facility.

After the juvenile has been taken into custody or released to their parent or guardian, an adjudicatory hearing will be arranged within 72 hours. At the hearing, the court resolves if the child has committed an offense and if they should be held in a detention center.

Since juvenile delinquents do not have the same constitutional protections as adults, they are not allowed a jury at the hearing. Still, they can have a lawyer and present witnesses in their defense.

Once the adjudicatory hearing has concluded, the juvenile will be sentenced if they are adjudicated of the offense at a dispositional hearing.
