Dayton Family Immigration Lawyer

Our country is founded on immigration, and immigration continues to play a foundational role in our nation. Immigration concerns, however, are as complicated as they are critical. If you have a family immigration law matter, it is important to you and your family, and it deserves the professional legal guidance that an experienced Dayton family immigration lawyer can offer.

Family-based Immigration

Family immigration is the primary mode of immigration to the United States. The way it works is that citizens of the United States and lawful permanent residents (LPR) are able to sponsor specific members of their families for green card status. Family visas and green cards in the United States account for the majority of all legal immigration each year.

Who Is Eligible?

The eligibility requirements for family visas are specific and include immediate relatives, such as:

  • Spouses of U.S. citizens
  • Unmarried children (under the age of 21) of U.S. citizens
  • Orphans adopted by U.S. citizens
  • Parents of U.S. citizens who are at least 21 years old

U.S. citizens and LPRs cannot, however, sponsor other family members like in-laws, aunts and uncles, cousins, or grandparents.

What Are the Requirements?

There is a lot involved in the family-sponsorship route to immigration in the United States, and it begins with the following important steps:

  • The relative who is sponsoring the family immigration must be at least 18 years old (and, in some cases, must be 21 years old) and must currently live in the United States.
  • To begin, the sponsor must file a petition for the family member he or she is sponsoring with the U.S. Citizenship and Immigration Services (USCIS).
  • In the petition, the sponsor must prove the legitimacy of their required relationship with the sponsored relative and must prove that he or she, as the sponsor, meets all necessary income requirements.
  • Additionally, the sponsor must submit a signed affidavit of support that establishes his or her commitment to supporting the candidate for immigration financially.
  • The candidate himself or herself must then proceed to undergo extensive background and security checks that include criminal, health, and national security screenings.

However you look at it, the path toward family immigration in the United States is a complicated process, and because the outcome is so critical to your family’s future, the best path forward involves having a dedicated family immigration lawyer on your side.
